The Information that we Collect, How we Collect it, and How we Use it

Personal data are processed by Paul Rich sp. z o.o., Niekłańska 38/18, 03-924 Warsaw, Poland, European Union, TIN: 1132910188, National Court Register Number: 0000616894, in order to use when necessary during your activity on our store. We collect information in two ways. First, we collect it automatically when you visit our websites or use our products and services. Second, we use it when you log in with your Facebook credentials through a Facebook or Instagram referral.

When you purchase something from our store, as part of the buying and selling process, we collect personal information you provide us such as your name, address, and email address. Additionally, when you complete a purchase with Paul Rich sp. z. o.o., we share your submitted shipping address for shipping purposes only. 

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. With your permission, we may send you emails about our store, new products, and other updates. We never sell or present personal data to a third party. We may disclose your personal information only if we are required by law to do so or if you violate our Terms of Service.

Data Storage

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data are stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data are stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

Paul Rich sp. z o.o. does not store nor see any credit card information.

Security of Data

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Links to Other Websites

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Cookies

Changes to Privacy Policy

Privacy Policy may be changed at any time and the change becomes binding on a given date. Customers will be informed about changes to Privacy Policy by e-mail. If the customer does not consent to changes made he may quit using the platform.

The Seller undertakes the highest effort to assure that the terms and conditions of sale will form customers' rights and obligations in accordance with good practices and taking into consideration customers' interests. Clients should note that our store is hosted on Shopify Inc. Shopify Inc. provides us with the online e-commerce platform that allows us to sell our products and services to you.


Acceptance

The customer should familiarize himself or herself with Terms of use. During registration on the website www.paul-rich.com or when placing an order, the customer will be asked to accept the resolutions of Terms of Use by marking “X” in a checkbox.

Order Fulfillment 

Online store sells products on the Internet, using the website www.paul-rich.com, on which orders may be placed. The subject of order will be further called “the Product”. The catalogue of the products is located on the website https://paul-rich.com/collections/all.

Orders most often take between 3 and 5 business days to arrive at their destination. 

Occasionally, depending on various factors like customs, orders can take in excess of 5 business days to arrive. The order is dispatched within 48 hours after payment has been made. In case of delay, please contact us by sending an e-mail to: support@paul-rich.com.

Age Verification

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state or province of residence, or that you are the age of majority in your country, state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Terms of Payment

We use PayPal and Checkout.com to process payments, so our staff is unable to see your payment details. PayPal is the world's largest and most secure payment provider. We accept PayPal and credit/debit cards (Visa, MasterCard, American Express). If you have a PayPal account, but you are having problems with sending money or logging into PayPal, please contact PayPal customer service. We don’t accept the service for cash on delivery (COD). We process orders in USD, EURO, GBP. While the content of your card may be displayed in other currency, you will checkout using USD, EURO, or GBP at the most current exchange rate.

Sales, Custom and Value-added taxes

In an effort to remain compliant with respective consumer legislations, we strongly encourage our end customers to maintain good standing with respect to customs and value-added taxes, where applicable. Due to separate and applicable tax jurisdictions, the end customers’ purchases may be subject to specific sales, customs or value-added taxes, and the shipping time and associated cost may increase.

Cancellation of orders

All orders can be cancelled within 1 hour when placed Monday through Friday between 9 AM and 5 PM Central European time. If your order has been paid and you need to make a change or cancel an order, you must contact us within that time frame. The support team does not work 24 hours and therefore cannot cancel your order outside the above time frame. We are connected to an automated warehouse management system and do not actively monitor the flow of orders. 

Orders placed on weekend can be canceled by 6 AM Monday, European Central time.  

Prices

Prices of products are in EURO and are gross prices. Prices located near products do not contain information about shipping costs, unless the delivery is indicated as “free shipping”. The total order cost is presented in clear and explicit way during review, after the choice of payment and delivery had been made. 

Refunds and Returns

If you are not completely satisfied with your purchase, simply return the item to us under
the condition that you are liable for any decrease in product’s value resulting from the usage of the product in a way beyond necessary to get to know the character, features and functionality of the product within 30 days of receipt by contacting
support@paul-rich.com.

We do not refund return shipping costs in Europe. 

If you want to return an item, please re-pack the item in an unchanged condition. The customer is liable to damages that decrease the product’s value resulting from the usage of the product in a way beyond necessary to get to know the character, features, or functionality of the product. You can expect to receive your refund within 5 days of your package return. However, in many cases you will receive a refund more quickly. 

We will return the payment to the card used during purchase. You are
obliged to return the order promptly by posting it to us not later than 30 days after the day in which you withdrew from the contract. It is sufficient to post the items back to preserve the term. You are liable for damages that decrease product’s value resulting from the usage of the product in a way beyond necessary to get to know the character, features and functionality of the product.

If you ship your intended return after the 30 day return period the items will be sent back to you and no refund will be issued. 

We do not accept returns of USED products. Used products will be mailed back to the sender and no refund will be issued.

If the watch has been worn, regardless of how long it was worn, the watch cannot be returned.

ANY SIGNS OF WEAR OR REMOVAL OF PARTS INCLUDING FOIL AND TAGS WILL RESULT IN REFUSAL OF YOUR RETURN.

Items purchased for a discount price

Items on sale can be returned. That includes ANY discount.

 

Complaints concerning faulty products

In a situation that a fault takes place, the customer can according to our guarantee make a complaint and demand one of the below actions:

a) exchange the faulty product for a new one;

b) repair the faulty product;

c) partial refund for the faulty product;

d) waive the purchase agreement when the fault is important.

The choice of the action belongs to the customer. Under particular conditions we are able to propose other solutions, but only considering the circumstances listed below:

a) facility and speed of exchange and repair of the product;

b) the character of the fault – important or not;

c) if the client has made any earlier complaints.

If the customer demands the exchange or repair of the item, we can refuse to fulfill this demand under the condition that the option indicated by the client:

a) would be impossible for us to fulfill;

b) would demand excessive costs in comparison to other solutions.

We can propose other solutions. Regardless of the previous solution, in this situation the customer can change his preferred choice and demand to bring the product back to the state specified in the agreement. We are obliged to replace the product or remove the defect in a reasonable time, no longer than 30 days since product receipt. If we do not meet this limit you can set a time demand, which we have to meet, but no shorter than additional 30 days. If we do not meet the deadline you are entitled to withdraw from the agreement or demand a partial refund for the product.

We bear the responsibility for a faulty product, if the fault takes place in a period of two years since the day of delivery. A complaint can be delivered in any form. For evidence purposes it is recommended to do this in writing. You should describe the fault and specify your demands as outlined in the guarantee. Proof of complaint may be sent directly to the us by a registered letter with reversible affirmation of delivery or sent by e-mail to support@paul-rich.com

If the demand placed by you in the complaint applies to:

a) repair of the product,

b) exchange of the product for a new one,

c) partial refund,

we are obliged to process your complaint within 14 calendar days from the date of the complaint. If we exceed this term your complaint is considered justified, no matter the factual state of the complaint. 

PRE-ORDER TERMS AND CONDITIONS

These Pre-Order Terms and Conditions (these “Terms”) govern the placing of pre-orders (“Pre-Order”) with Paul Rich LLC and its subsidiary Paul Rich Sp. z o.o. (the “Company”) for the Products (as defined below). Please read these Terms carefully before submitting your Pre-Order of any Paul Rich Products. By submitting your Pre-Order, you agree to be legally bound by these terms.

1. PRE ORDER REGISTRATION

When placing a Pre-Order for the Products, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Company shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time prior to your product being shipped by sending an e-mail to support@paul-rich.com

2. PAYMENT

You will be charged at the time of placing the order. Your placing of a pre­order constitutes your express agreement to the company charging of your provided payment method at such time. The purchase price does not include import duties, taxes and other government charges, which are your responsibility.

3. SHIPPING

Products are expected to be ready to ship at the date provided on the product page during placing your order, subject to reasonable delays in manufacturing and/or delivery. Such date is only an estimate, is subject to change, and Company does not represent or warrant that it will be able to ship the Product by the estimated date.  As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, Paul Rich Llc. and its subsidiary Paul Rich Sp. z o.o. is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. The Products will be shipped in the order in which your Pre-Order is received by the Company.  Shipments will be made Monday – Friday, excluding holidays, unless otherwise noted.

4. CANCELLATION

If you wish to cancel your order and thus receive a refund, contact us with regards to your refund request. Each refund request is processed on a case by case basis.

Allow 30 business days from date of request for full refund to be processed. Your placing of a pre ­order constitutes your express agreement to Paul Rich Llc. and its subsidiary Paul Rich Sp. z o.o. of charging the full Price of the Products at such time. 

5. DISCLAIMER

Paul Rich Llc and its subsidiary Paul Rich Sp. z o.o. DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PROTOTYPE PRODUCT DISPLAYED BY Paul Rich Llc and its subsidiary Paul Rich Sp. z o.o. WHETHER BEFORE OR AFTER YOU HAVE PLACED THE PRE-ORDER. YOU UNDERSTAND AND AGREE THAT THE PRODUCT, ITS DESIGN AND TECHNICAL FEATURES ARE CURRENTLY UNDER DEVELOPMENT AND THAT THE PRODUCT THAT MAY BE AVAILABLE FOR PURCHASE BY YOU MAY BE MATERIALLY DIFFERENTLY FROM THE PROTOTYPE PRODUCT. IF FOR ANY REASON YOU ARE UNHAPPY WITH THE FINAL VERSION OF THE PRODUCT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE TO CANCEL YOUR PRE-ORDER AS DESCRIBED IN SECTION 4 ABOVE.

 

6. Changes to the Terms

Paul Rich Llc and its subsidiary Paul Rich Sp. z o.o. reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your reservation as described in Section 4 above.

The customers may post comments and reviews on our website:
www.paul-rich.com. Illegal content should not be posted in comments and reviews. In such cases, we reserve the right to delete unlawful or illegal comments and reviews. 

Protection of Personal Data

Niekłańska 38/18, 03- 924 Warsaw, Poland, European Union, which is registered in Polish Court Register, XIII Commercial Department, National Court Register Number: 0000616894, Tax Identification Number: 1132910188, Statistical number: 364444189. Personal data are protected according to the polish Act about the protection of personal data, dated 29th of August 1997 (Dz.U. 1997 nr 133 poz. 883 with further changes), in a way that preclude third parties from getting access to them. According to the above act the client of the online store www.paul-rich.com has a right of insight to his or her personal data, can modify his or her personal data, and can also demand to remove his or her personal data.

When registering on the website www.paul-rich.com or when placing an order, the customer is required to make available personal data such as: name and surname, delivery address, and e-mail address. Above data is processed by us only to accomplish the order, among others to inform the client about the status of the order or to get the client’s opinion about his satisfaction with the delivered order. Payments are returned automatically to the card used during purchase. The customer may consent to processing of his personal data for purposes other than order realization, such as marketing purposes or subscribing to our newsletter.

The website is set to sell products. The customer is obliged to respect copyright law of the content posted on the website in accordance with the Polish Act of copyright and related rights, dated February 4th, 1994 (Dz.U. 1994 nr 24 poz. 83 with further changes). Access to some of the website’s features requires registering and logging in. Using the website is voluntary. Registering on the website is free. It is prohibited to post on the website content which is unlawful, proclaims racism, aversion to creed, ethnicity or popularizes violence, is commonly recognized as morally reprehensible, socially inappropriate or breaching rules of ethic.

Online store www.paul-rich.com uses cookies in order to implement a high level of security as well as ensure a high level of customer service. The customer can personally and at any time change the settings concerning cookies – set the conditions of storage and receiving the access of cookies files to his device by using the settings of his Internet browser or by using the configuration of a service tool.

Complaints concerning the functionality of our website, comments or reports which break the rules of this Terms of Use should be e-mailed to support@paul-rich.com. The administrator will respond to all complaints sent by e-mail or letter. The answer will be sent within 14 days since the receipt of the complaint to the address indicated in the complaint.

Changes of the Terms of use

Customers will be informed about changes to the Terms of Use by e-mail at least 14 days before the change together with a request to accept the new regulations of Terms of Use.
